Utah QDRO / DRO

Qualified Domestic Relations Order

WHAT IS A QDRO? If you are about to be divorced or legally separated and one of the assets to be divided is a retirement plan, then you most likely need a qualified domestic relations order (“QDRO”) (pronounced “qua'-dro”) A QDRO is a special court order that is often required to divide retirement accounts. It allows for the distribution of retirement assets between former spouses without incurring taxes or penalties.

HOW MUCH DOES A QDRO COST? $350 per spouse. This includes the drafting, filing and tracking of the QDRO. Once drafted and approved, we submit to the Judge for signature. After the Judge has signed, we obtain a certified copy of the order from the courthouse and mail to the retirement company for you.

WHEN DO YOU NEED A QDRO? This is a legal document that appoints an agent to manage your financial affairs if you become incapacitated. After a divorce, you may no longer want your former spouse to have this authority over your finances. It is important to designate a trusted individual to make important decisions on your behalf to help protect your assets and ensure your financial affairs are handed according to your wishes.
