FREQUENTLY ASKED QUESTIONS

Utah Divorce Mediation

HOW DO WE KNOW IF DIVORCE MEDIATION IS FOR US?

First and most importantly - BOTH spouses must be willing to participate in mediation. If you do not communicate with your spouse (or the other party) or they are unwilling to mediate, unfortunately we cannot help.

Mediation is a great option for those who value time and money, and are looking to lower conflict for you and your family. Divorce does not have to be a war. Please share our website with your spouse which outlines the many advantages of mediation that apply to both of you. Once both of you are ready, feel free to schedule a no-obligation consultation where we will answer your questions and go over our process.

CAN A MEDIATOR HELP ME WITH DIVORCE PAPERWORK?

Yes. Our Attorney-Mediators draft all required divorce paperwork and file with the court to finalize your divorce. The courts have a lot of procedural rules that must be followed or the filing will be rejected. You are also going to be legally bound by these documents for the rest of your life so you want to make sure they are done right.

HOW MUCH DOES MEDIATION COST?

Our flat fee pricing includes everything from start to finish. At the end of your consultation, your mediator will provide you with your all-inclusive flat fee for our mediation services based on your needs and unique circumstances. Our fees are 90% less than the average total cost of divorcing through attorneys and litigation. Payment plans are an option. Please contact us for more information.

DO I HAVE TO MEDIATE IN THE SAME ROOM WITH MY SPOUSE?

No. We separate the parties (in person or virtually) so each has the privacy they need and neither feels pressured or controlled. We know this can be an emotional and stressful time and want to ensure each side is heard and feels comfortable.

HOW LONG WILL IT TAKE TO GET DIVORCED

Most of our clients complete their mediation and divorce process in 45-60 days. That’s much faster than the average litigated divorce, which can take anywhere from 10 months to 2 years—or more.

Our efficient, focused approach avoids the typically long, emotional and financially draining litigated divorce process.

WHO PAYS FOR MEDIATION?

Commonly, spouses divide fees equally.  However, you and your spouse can ultimately decide how payment is divided. Additionally, your mediator can work with you on creative options for the division of fees if one or both do not have the availability to pay the fee upfront.

WHAT IF MY SPOUSE DOESN'T LIVE IN UTAH?

As long as Utah has jurisdiction over your case, we can mediate it.  Virtual mediations are highly productive and allow us to mediate regardless of where you or your spouse are located.
